Welcome to www.beeandyou.eu, Bee & You B.V. provides services to you subject to the notices, terms, and conditions set forth in this agreement (the "Agreement"). In addition, when you use any of our services, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they are incorporated into this Agreement by this reference. We reserve the right to change this Site and these conditions of use at any time. Bee & You B.V. provides the Bee & You B.V. Services subject to the following conditions. By using Bee & You B.V. Services, you agree to these conditions. Please read them carefully.

Bee & You B.V. trademarks and trade dress may not be used in connection with any product or service that is not Bee & You B.V., in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Bee & You B.V. All other trademarks not owned by Bee & You B.V. that appear in any Bee & You B.V. Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Bee & You B.V.

 

YOUR ACCOUNT
 

If you use any Bee & You B.V. Service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Bee & You B.V. does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use the Bee & You B.V. Services only with involvement of a parent or guardian. Bee & You B.V. reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders.

Bee and You™ reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant Bee and You™ a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Bee & You B.V. and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Bee & You B.V. for all claims resulting from content you supply.

Bee & You B.V. has the right but not the obligation to monitor and edit or remove any activity or content. Bee & You B.V. takes no responsibility and assumes no liability for any content posted by you or any third party.

RISK OF LOSS, OTHER TERMS OF SALE

All items purchased from Bee & You B.V. are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. Bee & You B.V. does not take title to returned items until we receive the item from the carrier. At our discretion, a refund may be issued without requiring a return. In this situation, Bee & You B.V. does not take title to the refunded item.

PRICING

Except where noted otherwise, the List Price displayed for products on any Bee & You B.V. Service represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The List Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day.

PRODUCT DESCRIPTIONS

Bee & You B.V. attempts to be as accurate as possible. However, Bee & You B.V. does not warrant that product descriptions or other content of any Bee & You B.V. Service is accurate, complete, reliable, current, or error-free. If a product offered by Bee & You B.V. itself is not as described, your sole remedy is to return it in unused condition.

Bee & You B.V. SOFTWARE TERMS

In addition to these Conditions of Use, the terms here apply to any software (including any updates or upgrades to the software and any related documentation) that we make available to you from time to time for your use in connection with Bee & You B.V. Services.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The Bee & You B.V. services and all information, content, materials, products (including software) and other services included on or otherwise made available to you through the Bee & You B.V. services are provided by Bee & You B.V. on an "as is" and "as available" basis, unless otherwise specified in writing. Bee & You B.V. makes no representations or warranties of any kind, express or implied, as to the operation of the Bee & You B.V. services, or the information, content, materials, products (including software) or other services included on or otherwise made available to you through the Bee & You B.V. services, unless otherwise specified in writing. You expressly agree that your use of the Bee & You B.V. services is at your sole risk.

To the full extent permissible by applicable law, Bee & You B.V. disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Bee & You B.V. does not warrant that the Bee & You B.V. services, information, content, materials, products (including software) or other services included on or otherwise made available to you through the Bee & You B.V. services, Bee & You B.V. servers or electronic communications sent from Bee & You B.V. are free of viruses or other harmful components. Bee & You B.V. will not be liable for any damages of any kind arising from the use of any Bee & You B.V. service, or from any information, content, materials, products (including software) or other services included on or otherwise made available to you through any Bee & You B.V. service, including, but not limited to direct, indirect, incidental, punitive, and consequential damages, unless otherwise specified in writing.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

DISPUTES

If you access the Site from within the Netherlands and European Union any dispute relating in any way to your visit to the Site, to these terms, to our Privacy Policy, to our advertising or solicitation practices or to products you purchase through the Site shall be submitted to confidential arbitration, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights, we may seek injunctive or other appropriate relief in any state or federal court and you consent to exclusive jurisdiction and venue in such courts. 

MODIFICATION AND SEVERABILITY

We reserve the right to make changes to the sites, Terms, the Privacy Policy and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
